Terms and Conditions. They provide important
information you (the "Traveler") need to
be aware of and follow. Additionally, they outline
the terms and conditions under which Cyrus Travel
will operate the tours advertised herein.
Important
Notice Regarding Travel to Iran:
It is common knowledge that the US Department of
State has a traveler's advisory in place for travels
to Iran. Travelers, including US citizens, entering
the Islamic Republic of Iran with a valid passport
and a valid visa should not encounter any
difficulties so long as they respect the form of the
government of Iran, the Islamic rules and
regulations, specially in so far as apparel, and the
culture and people of Iran.
Cyrus
Travel strongly advises the Traveler (1) to obey all
laws, rules and regulations while in Iran, (2) if
female, to cover the Traveler's hair, wear long and
loose dresses, covers or chadors, without any makeup
and nail polish, at all times and (3) if male, to
avoid wearing shorts and neckties, at all times. In
addition, the laws of Iran prohibit carrying any
type of alcoholic beverages, illicit drugs and
pornographic material.
Cyrus
Travel does not assume any liability, and expressly
disclaims any responsibility, for any loss, expense,
error, damage, delay, inconvenience, irregularity,
accident, injury or death to any person or property
that results directly or indirectly from a willful
or negligent act, or omission, of any person
connected, associated or affiliated with the
government of Iran, or who supports, or sympathizes
with, its form of government and/or policies, or who
disagrees with the government of US and/or its
policies, including, but not limited to, acts of
terrorism and/or fanaticism.
Fares
and Rates:
Fares and Rates are determined as of the time of
publication in November 1997 and are quoted in US
dollars. Fares and Rates are subject to currency
fluctuation, changes in airfare and/or hotel rates
and governmental taxes and tariffs. As such, Fares
and Rates are subject to change without notice, and
can only be guaranteed upon receipt and acceptance
of full payment.
Reservations:
Presently Cyrus Travel anticipates operating a total
of 6 tours during calendar year at the times
mentioned in this brochure. Cyrus Travel reserves
the right to cancel any of its tours and/or
reschedule their time at any time without prior
notice. Since group size is limited on each tour,
early reservation is recommended. Reservations are
subject to availability and are offered on a first
come first served basis. A $500.00 non-refundable
deposit is required, per person, at the time of
making the reservation. Full payment is due 45 days
prior to departure date.
Payment:
Cyrus Travel accepts payment by check, Visa,
MasterCard, Discover and American Express. Make all
checks payable to Cyrus Travel or the traveler's
travel agent, who in turn must make their checks
payable to Cyrus Travel. If payment is made by
check, the check must clear the bank and the funds
must be available to Cyrus Travel prior to any
reservation being secured and confirmed. If payment
is made by a credit card, (a) a signed, fully
completed universal charge form ("UCC"
without approval) for full payment must be received
by Cyrus Travel prior to any reservation being
secured and confirmed, and (b) the Traveler waives
any charge back rights the Traveler may have. Any
other person or entity (including a travel agent)
who receives or accepts money from the Traveler,
does so solely and strictly at the Traveler's risk
and as the Traveler's agent, and not as an agent or
representative of Cyrus Travel.
Cancellation:
If Cyrus Travel receives the Traveler's notice of
cancellation, in writing, 45 days or more prior to
the departure date, the Traveler will not be
responsible for any other fees beyond the Traveler's
non-refundable $500.00 deposit which will be
forfeited and retained by Cyrus Travel. For
cancellations received by Cyrus Travel less than 45
days prior to departure date, the following
additional fees will be deducted from the Traveler's
full payment before refund, if any, is made to the
Traveler within 14 days of the Traveler's
cancellation:

- 15 days prior to departure: $ 800.00 14 - 7 days
prior to departure: $1200.00 Less than 7 days prior
to departure: THE TRAVELER'S FULL PAYMENT - NO
REFUND
In
addition, any unrecoverable expense and/or
cancellation charges imposed by the vendors and/or
suppliers of Cyrus Travel will be assessed.
Medical
&/or Death Exceptions:
If serious medical condition necessitating
hospitalization and/or death preclude travel, a
valid death certificate and/or medical certificate
from the hospital must be supplied along with a
written request for cancellation and refund prior to
departure date. In such cases, the Traveler will not
be responsible for any fees to Cyrus Travel and
Cyrus Travel will refund the Traveler's $500.00
deposit to the Traveler within 45 days of receipt of
the above items. No refunds will be made, however,
for requests postmarked after the departure date. In
addition, Cyrus Travel will endeavor to obtain a
refund for the Traveler from its vendors and/or
suppliers and will return to the Traveler, within 45
days of its receipt, whatever refund it receives
from its vendors and/or suppliers. The availability
of these refunds is governed by the policies of each
independent vendor and/or supplier, and Cyrus Travel
does not make any representations and/or guarantees
that it will be able to obtain any refund.
Travel/Insurance:
Travel insurance is available and its purchase is
highly recommended. Please ask Cyrus Travel and/or
your travel agent for details.
Unused
Tour Arrangements:
After the Traveler's departure on the tour no
refunds will be made for any missed or unused ground
services, meals, hotel accommodations or airline
tickets.
Operator
Cancellation:
Cyrus Travel reserves the right to, and may, cancel
any of the scheduled tours at any time without any
prior notice for any reason including, but not
limited to, what Cyrus Travel in its sole discretion
deems to be insufficient response to any tour. In
the event of cancellation by Cyrus Travel, Cyrus
Travel shall not be responsible for any damages,
proximate or otherwise, consequential or incidental,
and its liability shall be limited to a full refund
of any portion of any payments allocable to unused
services, within 14 days of the cancellation.
Hotel
Accommodations:
Cyrus Travel has and will make every effort to
package a five star or one of the best available
hotels in each city visited. All rooms are double
occupancy, but single rooms are available at an
additional cost. If a hotel change becomes necessary
due to reasons beyond Cyrus Travel's control, Cyrus
Travel will use its best efforts to substitute a
hotel of equal category.
Baggage:
Cyrus Travel will provide each Traveler with one
complimentary travel bag. Airlines generally allow
two free checked bags and one carry on per person,
however, due to limited motor coach capacities in
Iran Cyrus Travel advises Travelers to carry only
one checked bag and the complimentary travel bag.
Cyrus Travel does not accept responsibility, and
will not be liable, for any loss of or damage to any
baggage or belongings while in the custody of any of
its suppliers and/or vendors including, but not
limited to, airlines, hotels and bus companies. It
is recommended that the Traveler purchase insurance
to guard against such contingency.
Passport
and Visa:
For travel to Iran the Traveler is required to, at
the time of entry, have a passport which is valid
for at least up to 6 months after the date of the
Traveler's departure from Iran. In addition, the
Traveler is required to have a valid visa for entry
into Iran. Details regarding this visa will be
provided at the time of reservation, and Cyrus
Travel will help the Traveler obtain this visa.
Failure to carry proper passport and/or visa may
lead to denied entry onto an aircraft or into Iran.
Currency:
Cyrus Travel strongly advises the Traveler to carry
the Traveler's money in traveler's checks. Any
foreign currency, such as US dollars, must be
converted to Iranian Rials in Iran ONLY under Iran's
laws.
Responsibility:
Cyrus Travel is a d/b/a of Cyrus Corporation, a
wholesale travel company located in California.
Therefore , all terms and conditions of tours
operated by Cyrus Travel are governed by, and shall
be interpreted in accordance with, the laws of the
State of California. Any dispute with Cyrus Travel,
if litigated, arbitrated and/or mediated, shall be
litigated, arbitrated and/or mediated in the State
of California, County of San Francisco.
Cyrus
Travel has packaged the tours outlined in this
brochure and it is responsible only for packaging
the services identified herein. None of the
suppliers, vendors and/or providers of services
outlined in this brochure are agents or employees of
Cyrus Travel, and are all independent contractors.
Cyrus Travel at all times in packaging the tours
outlined in this brochure has and is acting as a
tour packager only, and is not acting as a principal
or agent of the Traveler.
Cyrus
Travel does not assume any liability, and expressly
disclaims any responsibility , for any loss,
expense, error, damage, delay, inconvenience,
irregularity, accident, injury or death to any
person or property that results directly or
indirectly from acts of God, weather, strikes, wars,
hostilities, acts of terrorism, civil disturbances
or disobedience, willful or negligent acts, or
omissions, of any of its suppliers, vendors and/or
providers of service including, but not limited to,
failure to provide services or providing inadequate
and/or incomplete services, theft, delay,
cancellation of or changes in itineraries and/or
schedules, defects in vehicles and/or breakdowns in
equipment.
Cyrus
Travel reserves the right to cancel and/or
reschedule any of its tours or itineraries, and to
accept to or decline from its tours any person for
any reason. In the event of cancellation of a tour
or declination of a person, Cyrus Travel's
obligation shall be to refund any portion of any
payments allocable to unused services. |
